Terms of Service

By accessing or using this website (the "Site"), operated by Elite KO Academy LLC, a Florida limited liability company ("EKO," "we," "us"), you agree to these Terms of Service. If you do not agree, do not use the Site.

1. What This Site Is

This Site is informational and promotional. It describes EKO's boxing programs, displays the class schedule, and connects visitors to membership sign-up. It is not where membership contracts are formed, payments are processed, or class attendance is managed — those happen through Gymdesk, our gym-management platform (see Section 3).

2. Site Use vs. In-Gym Training

Browsing this Site carries no physical risk. Participating in boxing, sparring, or any physical training at our facility involves inherent risk of injury. Enrollment in any program requires completing membership sign-up through Gymdesk, which governs the terms of physical participation. This Site does not itself collect or store waiver acknowledgments.

3. Minors and Parental/Guardian Responsibility

Some programs, including Kids Boxing, are designed for children. A parent or legal guardian must complete enrollment on the child's behalf through Gymdesk. This Site's role for children's programs is informational only.

4. Membership, Billing, Cancellation & Refunds

All membership sign-up, billing, scheduling, and cancellation is handled by Gymdesk, not by this Site directly. This Site displays no prices. Cancellation and refund terms are governed by the agreement you enter into through Gymdesk at sign-up, and by applicable Florida law.

5. No E-Commerce on This Site

This Site does not process payments, sell products, or operate a shopping cart. No purchase can be made directly through this Site.

6. Forms and Information You Submit

This Site includes an embedded third-party form for independent coaches interested in training at the facility, which submits directly to Gymdesk. See our Privacy Policy for details. Do not submit information on behalf of someone else without their permission, and do not submit false information.

7. Content and Intellectual Property

Text, photos, graphics, and the EKO name and crest on this Site are owned by Elite KO Academy LLC or used under license, except where noted. You may not copy, reproduce, or redistribute Site content for commercial purposes without written permission.

8. Photography and Media

Photos of identifiable individuals may appear on this Site for marketing purposes, used with the consent of the person shown (or their parent/guardian, for a minor). If you appear in a photo on this Site and want it reviewed or removed, contact us.

9. Prohibited Use

Do not use this Site to violate any law, attempt to gain unauthorized access to any system, interfere with the Site's operation, scrape or harvest data at scale, or submit harmful code through any form on the Site.

10. External Links and Third-Party Services

This Site links to and embeds services we don't control, including Instagram and Gymdesk. We aren't responsible for the content, availability, or practices of these third-party services. Their own terms apply when you interact with them.

11. No Warranties

This Site is provided "as is." We make no warranty that the Site will be uninterrupted, error-free, or that its content (including schedule and program information) is always current — always confirm class times directly before attending.

12. Limitation of Liability

To the maximum extent permitted by law, Elite KO Academy LLC is not liable for indirect, incidental, or consequential damages arising from your use of this website. This limitation applies to use of the Site itself and does not limit, expand, or replace any separate liability waiver or release you sign as part of in-person training or Gymdesk membership enrollment.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

14. Changes to These Terms

We may update these Terms at any time. The effective date above will reflect the most recent revision. Continued use of the Site after a change means you accept the updated Terms.
